The Public Prosecutor’s Office of the State of Rio de Janeiro (MPRJ) filed an appeal to Justice to annul the acquittals of Rayane dos Santos, Marzy Teixeira and André Luiz de Oliveira of the accusations of involvement in the murder of Pastor Anderson do Carmo, which occurred in the early morning of 16 June 2019. A new trial of the three before the Jury Court is also requested, as it understands that the decision to acquit them “is manifestly contrary to the evidence in the case file”.
In the same appeal, the MPRJ asks that the sentences of former deputy Flordelis dos Santos and her daughter Simone dos Santos, already convicted, be raised.
Anderson do Carmo was shot dead by the biological son of the former congresswoman, Flávio dos Santos Rodrigues, at the family home, located in the Badu neighborhood, in Pendotiba, Niterói, a municipality in the metropolitan region of Rio de Janeiro.
According to the appeal, the acquittals of Rayane, André and Marzy are totally inconsistent with the evidence in the file, and should be annulled, so that the accused are subject to a new trial. The MPRJ demonstrates that, within the division of tasks established in the criminal association, Marzy and Rayane helped Flordelis in planning the crime and in convincing the already convicted sons Flávio and Lucas to carry out and participate in the murder.
Marzy and André, in turn, also participated in the attempted murder of Anderson do Carmo by poisoning, having secretly put toxic substances in the victim’s food and drinks, in addition to encouraging the commission of the crime and helping in the choice and acquisition of poisons.
Flordelis was sentenced on November 13 of this year to a total sentence of 50 years and 28 days in prison for triple homicide, attempted double homicide, in addition to using a false document and armed criminal association. The popular jury also sentenced the biological daughter of the former deputy, Simone dos Santos, to 31 years and 4 months in prison, for triple murder, attempted murder and armed criminal association.
The other three accused, Rayane dos Santos, biological granddaughter of the former deputy, Marzy Teixeira and André Luiz de Oliveira, adopted children of Flordelis, were acquitted.
