The Federal Public Prosecution Service (MPF) recommended to the Ministry of Management and Innovation in Public Services (MGI) and the Cesgranrio Foundation, the organizing board of the Unified National Public Competition (CPNU), the suspension of the disclosure of the final results of the Unified National Public Competition ( CNU) 2024 until failures in compliance with rules related to racial quotas provided for in Brazilian law are resolved.

According to the MPF, there is evidence that the Cesgranrio Foundation did not properly notify the reinstated candidates, compromising the equality among competitors. “As well as that it failed to properly substantiate the decisions of framing candidates in the quotas of black and brown persons,” says the MPF recommendation.

The Cesgranrio Foundation responded to National radiovehicle of Brazil Communication Company (EBC)that by contract, all press demands are concentrated with MGI.
Other recommendations
The MPF recommended the suspension of the disclosure of CNU final results until all administrative resources are properly analyzed and reopening the deadline for appeals to candidates.
In addition, the recommendation includes unrestricted access to opinions and decisions and the guarantee of isonomic treatment for all candidates (respecting the constitutional and legal rights of each). “Cesgranrio did not make available the opinions motivated to candidates not framed in racial quotas,” says the document.
According to the document, candidates who were not framed in the quotas of black and brown persons, with the clear motivation of decisions of rejection, must be reevaluated

Investigation
The investigation of the Federal Attorney’s Office for Citizen Rights/MPF also identified delay in the disclosure of the names of the evaluators responsible for heteroidentification, scheduled for October 17, 2024.
The disclosure took place on November 1st. This step consists of the analysis of the physical traits of candidates and candidates who called themselves black or brown.
The Prosecutor’s Office also points out that this assessment did not follow the parameter established in court, that, in case of reasonable doubt about the racial identity of the candidate, the criterion of self -declaration must prevail.
Candidates
THE Brazil agency He talked to black and brown self -declared candidates in the Unified National Public Tender. The server of the National Institute for Educational Studies and Research Anísio Teixeira (Inep), Gustavo Amora signed up for the vacancies of the 4 (Work and Health of the Server).
He was approved in the objective and discursive tests of the contest. However, in the heteroidentification phase, it was classified by the Cesgranrio Foundation board as “not framed”. He filed an administrative appeal and received the same negative again.
Gustavo received with joy the news of the recommendations made by the MPF. “This is just a start of the MGI reckoning that MGI has to do with Brazilian society about these abuse all that were committed at CNU.”
The candidate, who went to court against the decision of Cesgranrio’s heteroidentification board and has lost in the first instance, now hopes that the recommendations will be considered in the judgment of the legal appeal (interlocutory) filed in the Federal Regional Court of the 1st Region to contest the previous decision.
Octavio Neto, 24, who was qualified for the five vacancies chosen within Block 5 of the CPNU, and, according to Cesgranrio’s heteroidentification board, has no physical traits corresponding to those of black people, now acts as a lawyer.
He has not yet judicialized the case of CNU, as he awaits the definitive result of another contest in which he was not recognized as black candidate for another bank. “For my experience, having to believe that the resources are not analyzed, they are not read and, if they are, are performed in a very deficient way.”
Social worker Helena Oliveira Barros, who ran for a vacancy in Block 7, claims to have been shocking to receive this not framing by the heterohydict’s banking of the event. “It is as if the floor had come out of my feet, because I have suffered prejudices, I have experienced painful experiences about mine and never thought that after 54 years someone would say that I am not black, much less brown,” he says.
Mental health
Psychologist Rosane Romão, a master’s degree in Business Administration and PhD student from the Fluminense Federal University (UFF), analyzes the mental health of black self -declared people from all over Brazil, who prepared and applied for the so -called Enem of the contests and which in the evaluation of the Heteroidentification commission were not recognized as black people.
The professional understands that this negative can bring many psychological, psychological, emotional, psychosomatic disorders, identity crises to candidates excluded from the racial quota of the selection process. “The state is saying that this candidate, this person, is not who he is. That there is no truth in what she had been calling herself. This is very serious. By the time after much study and dedication, it can reach a better position, this state once again prevents it, now saying that it is not black. It’s bleak. ”
