The Public Prosecution Service of Paraná (MPPR) appealed to overthrow the decision granting house arrest to former criminal police officer Jorge José da Rocha Guaranho, sentenced by the murder of the Municipal Guard and former Treasurer of the State PT Marcelo Aloizio de Arruda in 2022.
On Friday (14), Guaranho left the arrest after being sentenced to 20 years in prison by the Jury Court of Curitiba. The former criminal police officer was attending house arrest and was arrested on Thursday (13) after the trial.
THE habeas corpus It was granted by Judge Gamaliel Seme Scaff of the Court of Justice of Paraná (TJPR). The magistrate agreed with defense arguments and decided that Guaranho will return to house arrest and wear an electronic anklet.
The lawyers claimed that Jorge Guaranho has health problems and should remain in house arrest. According to the defense, the convict was also shot on the day of the crime and beaten, requiring medical treatment of injuries.
Appeal
In the appeal filed on Monday (17) to the first criminal chamber, the MP states that Jorge Guaranho has “a high degree of literalness” and should be arrested based on the decision of the Supreme Court (STF) that determines the sovereignty of the verdicts of Jury Court.
Prosecutors also said medical treatment can be performed at the prison.
“It is not found that the patient is extremely debilitated – as observed from the videos published in the media that captured their entry and/or exit of the forum, as well as the video of their interrogation in plenary – or unable to receive care in the prison establishment,” supports the MP.
The crime occurred in July 2022, in the municipality of Paraná of Foz do Iguaçu, amid the election campaign.
According to the investigations, Guaranho went to the petista theme party in which Marcelo Arruda celebrated his 50th birthday and made provocations of political nature, playing, in high volume, songs alluding to then President Jair Bolsonaro.
After the beginning of an argument, there was shots between the two, and Arruda was killed. Guaranho was injured during the exchange of fire and was admitted to the Intensive Care Unit (ICU) of a hospital in Foz do Iguaçu.
After recovering, he was arrested and denounced by the prosecutor for doubly qualified homicide. Danger production and futile reason were the qualifiers used by prosecutors to support the complaint.
