Even with criticism from the federal government, the president of the Chamber of Deputies, Hugo Motta (Republicanos-PB), maintained the vote on the replacement of the Anti-Faction bill (PL) for this Tuesday (18).
“The project increases penalties for members of factions and makes it difficult to return to the streets, it also creates and integrates the National and State Data Banks on Criminal Organizations. Let’s move forward with responsibility and the urgency that the issue requires”, said Motta, this Monday (17), on social media.
There is an expectation that the rapporteur, federal deputy Guilherme Derrite (PP-SP), will present a new text before the vote, which will be the fifth version of the substitute in just over a week.
The federal government maintains that the substitute for rapporteur Derrite disfigured the Executive initiative sent to Parliament to combat criminal organizations and that the opinion will create “legal chaos” that could benefit criminals.
The national secretary of Legislative Affairs of the Ministry of Justice and Public Security Marivaldo Pereira told Agência Brasil that the text will delay ongoing investigations and criminal actions.
“If the proposal is approved as it is, we will see real legal chaos, because there are a series of conflicting rules that will open an opportunity for those under investigation to start questioning which rule is actually applied”, he argued.
The government still complains about the rapporteur’s decision to withdraw federal resources that finance the Federal Police (PF).
“We sent a proposal with the objective of decapitalizing crime. The rapporteur presented a proposal that decapitalizes the federal government’s security funds. The proposal as it stands decapitalizes the federal government’s funds and will directly harm the PF’s operations”, added Marivaldo.
Experts have also pointed out that the project could complicate investigations of the Public Ministry (MP). The rapporteur informed the Brazil Agency which will adjust the text to leave no doubt regarding the role of the MP in combating criminal organizations.

The PL Antifaction rapporteur, Guilherme Derrite, promised to present the 5th opinion with new changes to the text. For him, the criticism targets the increase in penalties for members of criminal organizations.
“Today, a gang member who kills a child can only be imprisoned for 4 years and 8 months. The federal government wanted it to remain the same. In my report, the sentence goes to 30 years, at least 21 in a closed regime. We went from less than five years to 21. Draw conclusions about the indignation of so many people”, said Derrite on a social network.
The government’s original project increased penalties against members of criminal factions, but not to the level proposed by the new rapporteur. The government has stated that it agrees with the increase in penalties, but asks that the other contributions of the original PL.

Rapporteur Gulherme Derrite presented four different versions of the Antifaction PL with adjustments to meet criticism from the government and experts.
One of the changes removed the obligation for the PF only act against factions with a formal request from the state governor, a measure seen as removing the PF’s powers.
Rapporteur Guilherme Derrite, who took leave from the position of Secretary of Security of São Paulo just to report this project, he always denied that he tried to take away the PF’s prerogatives.
Another change by the rapporteur removed the provision of including factions in the Anti-Terrorism Lawwhich could, according to the government and experts, be used by foreign nations to intervene in Brazil’s internal affairs.
