Minister Alexandre de Moraes of the Federal Supreme Court (STF), just determined the arrest of former President Fernando Collor.
The measure was taken after the minister denying a appeal from Collor’s defense to review CONDEMNATION TO 8 YEARS AND 10 MONTHS of imprisonment for passive corruption and money laundering in one of the processes of Operation Lava Jato.
In 2023, Collor was convicted by the Supreme Court in one of Lava Jato’s processes. According to the conviction, the former president and former senator, as former PTB leader, was responsible for political nominations for BR Distribuidora, a subsidiary company of Petrobras, and received R $ 20 million in improper advantages in the company’s contracts. According to the complaint, the crimes occurred between 2010 and 2014.
In the decision, Alexandre de Moraes considered that the funds filed by Collor’s defense are delayed to avoid the end of the process.
“The manifest inadmissibility of the embargoes, according to the jurisprudence of the Court, reveals the merely delaying character of the infringers, authorizing the certification of the res judicata and the immediate compliance with the conviction,” said the minister.
Moraes also asked the Supreme Court President, Minister Luís Roberto Barroso, the convening of a virtual session to endorse his decision. The virtual trial will be held this Friday (25).
Defense
In a press release, Collor’s defense said he received the decision with “surprise and concern.” According to the lawyers, the former president will present himself to start serving the sentence.
