Minister Alexandre de Moraes, of the Federal Supreme Court (STF), denied this Friday (19) an appeal presented by the defense of former president Jair Bolsonaro against the sentence of 27 years and three months in prison in the criminal action of the coup plot.
Last month, lawyers filed so-called infringing embargoes to try to overturn the minister’s decision that denied another defense appeal, the embargoes for clarification, and ordered the execution of the conviction of Bolsonaro and six other defendants from Core 1 of the coup plot.
In the decision, Moraes considered the appeal delaying and reaffirmed that the former president is not entitled to infringing embargoes.
“Since the definition by the STF plenary, this understanding – the requirement of two acquittal votes for the application of embargoes infringing the decisions of the groups – has been applied in all criminal actions, including those related to the crimes of attacking democratic institutions and the attempted coup d’état, which culminated in the coup acts of January 8, 2023”, decided the minister.
To get the case tried again, Bolsonaro needed to obtain at least two votes for acquittal, that is, a minimum score of 3 votes to 2 in the vote. trial held on September 11th and who convicted the accused. However, the score for conviction was 4 votes to 1.
Bolsonaro is imprisoned at the Federal Police Superintendence (PF), in Brasília, where he is serving a definitive sentence for his conviction.
