Moraes authorizes Daniel Silveira to progress to semi-open

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), authorized this Monday (7) former federal deputy Daniel Silveira to progress to the semi-open prison regime. Silveira was sentenced by the STF to eight years and nine months in prison for the crimes of attempting to prevent the free exercise of powers and coercion during the process by making insults and threats against the Court’s ministers.

In May last year, Moraes ordered the immediate execution of Daniel Silveira’s sentence. The measure was taken after the Supreme Court annulled the constitutional grace decree granted by former president Jair Bolsonaro to the then federal deputy to prevent the beginning of the sentence.

In the decision handed down today, Moraes understood that Silveira meets the legal requirements for progression to prison. The minister also highlighted that the measure received an opinion from the Attorney General’s Office (PGR).

“In view of the above, I grant the progression to the semi-open regime to the sentenced Daniel Lúcio da Silveira and I order the State Secretariat of Penitentiary Administration of the State of Rio de Janeiro to adopt the appropriate measures to carry out his transfer to an agricultural, industrial or similar establishment”, he decided.

The request for progression was made by Silveira’s defense. For lawyers, the former parliamentarian was illegally imprisoned beyond the legal deadline for progression.
