Minister Alexandre de Moraes, of the Federal Supreme Court (STF), ordered the defense of Filipe Martins, former advisor to former president Jair Bolsonaro, to speak out about possible non-compliance with precautionary measures imposed on the defendantwho was sentenced to 21 years in prison for participating in the coup plot and is currently under house arrest. Moraes’ decision was published this Monday (29), and the deadline set for lawyers to respond is 24 hours.
In your order, the minister informed that the news was added to the file that Martins had used the social network LinkedIn to search for third-party profiles, a practice prohibited by the magistrate under house arrest.
In addition to not being able to use one’s own social networks or those of third parties, other precautionary measures of house arrest include, for example, prohibition of communicating with other people under investigation, surrender of all passports and immediate suspension of any firearm possession documents in the name of the defendant. If not complied with, the measures may lead to the ordering of preventive detention in a prison unit.
Despite already being convicted, Martins is not yet serving his sentence because the sentencing ruling issued by the First Panel of the STF is pending publication.
Last week, Moraes had ordered to house arrest de Martins and nine other convicts. House arrests were ordered to prevent further escapes. This is because, on Friday (26), the former director of the Federal Highway Police (PRF) Silvinei Vasques was detained by local authorities after fleeing to Paraguay and trying to board a flight to El Salvador with a false passport.
In Moraes’ understanding, there is a strategy for those convicted of coup acts to flee the country.
