“As well observed by the Public Prosecutor’s Office in final arguments, the criminal authorship was not sufficiently proven, with reasonable doubt remaining about the agent’s intent. Given the statements made by the accused and the narrative presented by the technical defense, in comparison with the absence of other elements evidence, there remains reasonable doubt as to the criminal authorship, specifically with regard to the presence of the subjective element (intent)”, says an excerpt from the decision.
According to the records, Jeferson arrived at the camp set up in front of the Army Headquarters (HQ), in Brasília, to ask for food, on January 6, 2023, two days before the invasion of the headquarters of the Three Powers. He remained there until January 9th, when he was prevented by the military from leaving, and detained on the same day. He obtained provisional release later that month, but was arrested again in November 2023, for failing to comply with the order to appear in court, and began serving his sentence at the Andradina Penitentiary, in the interior of São Paulo, where he remained for just over a year. year.
The process also describes that Jeferson has a record of service at the Homeless Population Assistance Center (Centro Pop) in Ponta Grossa (PR), is a wanderer, obtains income through small services and donations, and does not have a physical address. staying overnight in hostels, hotels or gas stations.
This is the fifth acquittal of a defendant involved in the coup acts. According to the STF, in total, of the 1,552 ongoing criminal actions, there were 371 convictions and 527 non-criminal prosecution agreements. There are 78 provisional prisoners, 70 permanent prisoners (serving sentences) and seven under house arrest.

Next Wednesday (8), when two years have passed since the coup attempt, President Luiz Inácio Lula da Silva will coordinate a ceremony in memory of the anti-democratic episodes, at Palácio do Planalto. The event’s activities include the reincorporation of 21 works of art vandalized during the invasion of the palace, the holding of a public session with authorities and an activity with popular participation, in Praça dos Três Poderes, which is being called Embrace of Democracy.
Authorities from the Republic, members of the Ministry of Culture (MinC), the Institute of National Historical and Artistic Heritage (Iphan), the Federal University of Pelotas (UFPel) and the Swiss Embassy, as well as social movements, will participate.
One of the planned moments is the unveiling of the painting The Mulatasby Di Cavalcanti. Another will be the delivery of works of art, including a 17th century Swiss clock and an Italian amphora (vase), seen as symbols of the difficulty and delicacy of the repairs. The watch was repaired in Switzerland at no cost to the Brazilian government.
The end of the restoration process will also be announced, with the delivery of all 21 restored works.
