The Ministry of Tourism canceled the registration of the company HURB – Hotel Urbano Viagens e Turismo SA, which prevents it from operating in the tourism sector. The Digital Travel Agency faces complaints for contractual breach, as well as complaints from consumers in the administrative and judicial sphere.
The company has 10 days to appeal, from the publication of the decision in the Official Gazette of the Union on the last day 14.
By determination of the National Consumer Secretariat (Senacon), the Ministry of Justice and Public Security, HURB will also have to present detailed information about its financial situation. The number of contracts still pending, the total amount due to consumers and the list of affected customers were required. In case of non -compliance, a daily fine of R $ 80 thousand is planned.
Senacon considered the performance of the unfeasible company of the operational, technical and financial points of view. The agency says it was 12 months of attempted agreement to sign a Conduct Adjustment Agreement (TAC).
The National Consumer Secretary, Wadih Damous, said that HURB had all the opportunities to present minimum guarantees of compliance with the obligations.
“Senacon does not negotiate with bad faith, omission and disrespect to the Brazilian consumer, and the measure of the Ministry of Tourism is necessary and consistent with the facts,” Damous said in a statement.
“The cancellation of registration in the register reinforces that it is not admissible to operate in the tourism market without meeting legal requirements and respect for the consumer. Citizen protection is at the center of public policy,” added the director of the Department of Consumer Protection and Protection (DPDC), Vitor Hugo do Amaral.
In a public note, called the “Open Letter to the Market”, HURB said it started a dialogue with Senacon for over 15 months, with the aim of reaching an agreement, which served travelers impacted by the Covid-19 pandemic. But he says he was surprised by a movement that “seemed more political than coach,” and that Senacon “abandoned the negotiating table and left for the attack.”
