The Minister of Justice and Human Rights, Juan José Santiváñezdefended the questioned amnesty law approved by our country, during his speech before the United Nations Human Rights Council.
“Regarding the mention made by the High Commissioner on the adoption of the Amnesty Law, this has occurred according to the principle of separation of powers and in response to the terrible attack of terrorism that sought to break democracy and the rule of law, generating great suffering in our people,” said Santivañez.
“Peru will continue to cooperate with the Office of the High Commissioner to strengthen the protection and promotion of human rights but not before recognizing that all peoples have the right to their freedom, their independence, to their self -determination and build their own history regardless of interference of any kind,” he added.
In another part of his speech, the minister declared that our country continues to evaluate its permanence in the Inter -American Human Rights System, due to the resolution of this entity against the questioned amnesty law.
“In that context, in the face of the Resolution of the Inter -American Court of Human Rights, Peru will continue to evaluate its permanence in the Inter -American Human Rights System, as well as the need to promote a review of the substantive and procedural norms that regulate the system.”

As is known, the Inter -American Court of Human Rights confirmed that the Amnesty Law for Police and Military personnel who were accused, investigated or sentenced for crimes against humanity in the 80’s, 90’s and 00’s is inapplicable.
Through a new resolution published this Friday, September 5, the Court-IDH held its position on the ‘Amnesty Law’ cannot be executed because it violates the American Convention, also known as the San José Pact.
This international treaty guarantees the fulfillment of all agreements on civil, political, economic, social and cultural rights of all persons under the jurisdiction of the signatory states, such as Peru.
