The Minister of the Interior, Juan Jose Santivañezchose Luis Vivanco Gotelli as his lawyer Nicanor Boluartebrother of President Dina Boluarte, according to a protected witness of the Prosecutor’s Office.

According to the informant, identified by code 11-2024, on May 10, Santiváñez, who was then Vice Minister of Internal Order, summoned Vivanco to his office after learning of the arrest of the eldest of the Boluarte brothers for the Los Waykis en la Sombra case.
At that meeting, according to the testimony, the current minister and Vivanco agreed that the latter would be in charge of Nicanor’s legal defense.
“At that meeting, Juan José Santiváñez indicated to Luis Vivanco that by order of the president he was going to assume the technical defense of Nicanor Boluarte, but since his position of trust prevented him from assuming the active defense, he asked Vivanco to be the one to appear as the lawyer of the president’s brother and to be present at the proceedings that take place during the days of preliminary detention, which was accepted by the lawyer Luis Vivanco,” said the protected witness, as shown by the fiscal provision to which he had access. Precisely on May 10, Vivanco submitted a document to the offices of the Special Team against Corruption in Power (Eficcop) announcing that he was the lawyer for the eldest of the Boluarte brothers.
The testimony contradicts statements later offered by Vivanco and the minister, who said that at that meeting they did not discuss the defense of the presidential brother but rather topics such as “urban terrorism.”
Currently, Eficcop is supporting its request for 36 months of preventive detention against Nicanor Boluarte for the Waykis case, in which he is accused of leading a criminal organization to appoint, from the Ministry of the Interior, prefects and sub-prefects who led the constitution of the Ciudadanos por el Perú party.
The cell phone disappears
Protected witness 11-2024 also indicated that, as deputy minister, Santiváñez coordinated with Jorge Luis Ortiz Marreros, former director of the Interior Government, so that he would not report Nicanor Boluarte.
According to the investigation, Ortiz was a confidant of the president’s brother and from his position he allowed the appointment of prefects and sub-prefects.
The testimony indicates that, when the preliminary arrest warrant was issued against Boluarte, Ortiz and other ‘Waykis’, the latter was in hiding but Santiváñez contacted him by telephone to guarantee his legal defense.
And, in addition, the now minister told his then subordinate to make his cell phone disappear because it contained evidence of communications with Nicanor.
“So Ortiz Marreros removed the SIM card from his cell phone and then hid the cell phone, but to continue communicating with Santiváñez Antúnez, Ortiz placed the SIM card in another cell phone (…) To that statement, Juan José Santiváñez added that his cell phone had to disappear because said device had information that would harm Nicanor Boluarte,” reads fiscal provision 04-2024.
