On February 23, 2014, officials from the General Directorate of Military Counterintelligence (Dgcim) appeared at the home of the retired soldier, located in the Prados del Este urbanization, with an arrest warrant without the signature or seal of a court. General Vivas said that he would not turn himself in, barricaded himself in his house and declared himself a civilian in rebellion against the established authorities.
In April 2017, the soldier was finally arrested after going out to help a person who crashed his vehicle into the gate of his house, which was later denounced as a strategy to arrest him. He was missing for several days and was held at the headquarters of the Bolivarian National Intelligence Service (Sebin) known as El Helicoide.
Little more than a year later, on June 1, 2018, General Vivas was released from prison with precautionary measures by order of the Executive due to the serious health problems he developed in prison due to the cruel treatment to which he was subjected. He had a spinal fracture and prostatic hyperplasia that made it difficult for him to urinate.
In December 2021, the Inter-American Commission on Human Rights (IACHR) extended the precautionary measures in favor of the general’s family, as they consider that they are still “in a serious and urgent situation of risk of irreparable damage to their rights in Venezuela. ”.
