The Mexican Government, through the Ministry of Finance and Public Credit (SHCP), proposes to grant a benefit to natural and moral persons that return resources of law less three years.
The head of the Tax Administration Service (SAT), Antonio Martínez Dagnino, explained that with the measure it seeks to increase internal investment in key and infrastructure sectors, and in debt instruments. Also generate new job opportunities, increased economic activity, and new tax revenues.
He said that with the last program, 2017 when an 8%rate was offered, about 380,000 million pesos were repatriated, for which they entered the public treasury between 20,000 and 25,000 million, “we reviewed that program in the previous administration and right now we are improving that program and is what is being proposed,” said Martínez Dagnino.
In a context in which the legal and legal framework for money laundering prevention is also reinforced, rules and adjustments must be issued to ensure that the resources that may return are of lawful origin.
“I think that general rules of the SAT will be necessary to establish the mechanisms to demonstrate that these are lawful resources, otherwise it will be very difficult to be certain of how to prove that the resources are lawful,” said Luis Pérez de Acha, founding partner and director of the Pérez de Acha and Ibarra de Rueda.
With these tax amnesty programs, “there are benefits for the country because there is an increase in the return of resources, and that helps increase GDP, and on the other hand the taxpayer is helped with a lower rate, and with the fulfillment of omitted obligations,” explained the vice president of relations and dissemination of the Mexican Institute of Public Accountants (IMC), Rodolfo Servín.
He explained that all Mexican persons with investments abroad have the obligation to deliver informative statements to the SAT, not comply with that obligation has a three -year prison sentence
“When I have investments abroad and I am ignored of these formal obligations, a decree of an amnesty such as the repatriation decree, also seeks to correct those omissions,” said the BMP member.
