Mexico will remove all this unionism of lies: specialists

The recent union processes are a clear example of the activity that will take place in the companies to comply with the 2019 labor reform and the labor chapter within the T-MEC, since Mexico is expected to change to remove all that fake unionism, labor specialists presented.

Interviewed by the specialists, they stated that the “union effervescence” will continue in General Motors, whose process has not concluded; which will imply a change in the automotive industry, regarding collective bargaining.

Manuel Fuentes, labor lawyer, explained that “what happened at General Motors is an oxygen to the hope of the workers, especially for the union community, and for international observance, because this is how changes and improvements can be made. in collective labor contracts.

He stressed that the more than fifty companies that exist in the country and that provide direct or indirect jobs close to a million people, obviously, “gives an idea of ​​the importance of why the United States alleges that this has meant job losses for them and in Mexico, because what is observed is that this large industry has to ensure that there are really decent wages for workers and good collective bargaining agreements”.

Likewise, he stressed that the labor reform also expands freedom, even for “non-unionization”, cases can be presented in General Motors “in which workers prefer not to join. The labor reform itself favored in article 110 the possibility that the worker asks the employer not to pay any type of union dues. Although the labor reform on the one hand supports an issue of trade union democracy, but at the same time allows the weakening of the unions, and this double scenario allows that a big door be opened where the number of workers who do not want to unionize increases”.

Meanwhile, Ricardo Martínez foresees that “there is a stronger trade unionism in the country and the bosses have to face it and be better bosses, provide better working conditions and the unions to strongly represent union members without killing the companies because otherwise we will leave.” to be unemployed”.

He added that “the case of General Motors is a very clear example of the application of the collective labor reform. First, they lost their legitimacy with the vote of more than 60% who said that they no longer wanted that collective contract or that union, and there you realize that the right of association is now transmitted to the workers; but the interference of the United States is also clearly seen, it got involved a lot there with the NGOs and the interference of leftist unions and the new unionism is also clearly seen”.

In turn, Germán de la Garza de Vecchi, Lead Partner of Labor Services at Deloitte Mexico, added that “the General Motors process is interesting because it has broken paradigms, it has been answered that there is a new unionism, so more than ever the decision of workers within an organization has more weight than ever. This new way of legitimizing collective contracts will also generate a rebalancing of the union forces in the country”.

This process marks a new reality in Mexico, and is a sign of the new times in collective matters in the country.
