According to the request, these prices do not cover the production costs of Mexican apples, they contain national prices and affect the economic and financial indicators of the national production branch, which would have generated material damage.
He investigated period comprises of April 1, 2024 to March 31, 2025while the damage analysis covers the April 1, 2022 to March 31, 2025. The Secretariat determined that both periods meet the criteria established in the applicable legislation and in the recommendations of the Antidumping Practices Committee of the World Trade Organization.
The product under review is fresh apples arriving from the United States, regardless of variety, color or size. The document mentions common varieties such as Red Delicious, Golden, Gala and Granny Smith. Washington concentrates around 70% of US apple production.
The resolution states that, although there are commercial differences between varieties, they all share the same essential characteristics.
Apples enter Mexico under a tariff fraction that, under normal conditions, pays a 20% tax. However, currently these imports are exempt from paying tariffs until December 31, 2025, due to current decrees that apply to basic consumer products. Furthermore, since these are goods originating from a country with a trade agreement, they can receive preferential treatment if they meet the corresponding requirements.
The application describes the apple production process in Mexico, which includes the planting of trees, the growth of the orchard over several years, manual harvesting, storage in cold rooms, packaging and distribution. Among the main inputs are land, water, fertilizers, fuel and labor.
To review import prices, the Ministry of Economy will use official information from Mexican customs and the country’s trade balance. It will also take into account price references from the US market, obtained from official publications of the United States Department of Agriculture, which concentrate data from the main producing states.
The resolution clarifies that this stage only marks the beginning of the procedure. From now on, importers, exporters and other interested parties will be able to participate and present information. The authority will continue the analysis before issuing a final decision on the case.
