The Constitutional Court issued a favorable opinion for the issue to be resolved by the voters of the parishes in the northwest of the District.
The plenary of the Constitutional court, with a majority vote, issued the favorable opinion of the proposals of referendum about the exploitation of metal mining in the parishes of the northwest of Quito. The decision was announced on the afternoon of this Friday, January 28, 2022.

According to the CC, the referendum will include the voters who live in the Metropolitan District of Quito and its effects will be limited to the parishes rural of Nono, Calacalí, Nanegal, Nanegalito, Gualea and Covenant.
In its opinion, the cut reiterated that the effects of referendum, before an affirmative pronouncement of the electorate, will only be for the future and must be implemented by the different levels of government within the scope of their powers, which includes the decentralized autonomous governments and the national government.
The cut reiterated that neither this opinion nor the result of the eventual plebiscite should be understood as an attribution or recognition of powers that have not been conferred by the legal system.
As reasoned in the opinion, the cut provided that the text of the questionnaire that is submitted to the voter also contain the following text at the end:
The measures to be adopted in case they are approved in the plebiscite will operate towards the future respecting the institutional competencies established in the Constitution and the law. The official map of the parishes on which these measures will have effect, drawn up by the Municipality of the Metropolitan District of Quito, constitutes referential information for purposes of consultation.
Finally, the agency decided to proceed in accordance with the process prescribed for popular queries in the Constitution, article 184 and other pertinent articles of the Democracy Code. (DPV)
