Within the framework of the Peru Impulse Plan, the Ministry of Economy and Finance (MEF) modified the Regulations of the State Procurement Law to speed up public investment. In this sense, the credit line requirement is abolished as a qualification requirement in public tenders, in order to avoid deserted processes and increase the participation of suppliers.
It is worth mentioning that the modifications made were established by Supreme Decree 234-2022-EF, which will enter into force within the following 15 business days from the date.
Among the regulations that speed up the execution of public spending, it is established that after a first deserted electronic reverse auction, the simplified adjudication can be used.
Additionally, the bidder is allowed to reduce its economic offer when it exceeds the estimated value in selection procedures to contract goods, services and consultancies in general, to prevent the procedures from being declared void.
In addition, among the measures to promote the completion of works, the parties are empowered to include in the work contract a clause for the constitution of the trust for advances. On the other hand, the entities must prepare the liquidation of the work contract within 90 business days following the publication of the Decree, which will allow the entities to update their prioritized investments that are registered in the Investment Bank.
Finally, it should be noted that the selection procedures initiated before the entry into force of Supreme Decree 234-2022-EF are governed by the regulations in force at the time of their call.
