Only 25% of 1,869 applicants reached the minimum score of 105 in an examination of the Council of the Magistracy that evaluated the knowledge about the National Constitution. The contest, developed on November 25, was carried out for the integration of the shortlists of various edicts for judges of first instance, prosecutors and chambermaids.
Subsequently, the applicants asked Dr. Oscar Paciello, president of the Council of the Magistracy, to redo the exams because they were allegedly loaded with questionable items and leading questions.
In this regard, the head of the institution announced that all complaints made will be received, this in order to improve eventual errors or deficiencies. “But, how do you tell the 480, who reached the minimum score, that they should perform again or their effort was useless?”, Dr. Paciello pointed out in an interview for ABC Cardinal.
In this way, he hinted that they will not consider the request, as they will break with the principle of equality when redoing the exam. They will be receptive to complaints, but they do not agree on the existence of an error within the formulations of the items, because if 480 people were able to respond and understand the sections, the problem was really another.
“In any case, I recommend that you prepare more for the next exam. Many did not take this with due seriousness, they believed that it would be a simple thing, when clearly it is not like that, in the case of an exam “, determined the head of the Council.

The general malaise in several applicants who could not meet the minimum score rests on the way in which the test was developed. One of the main complaints was based on the fact that the test was elaborated exclusively on the National Constitution, without taking into consideration other laws that deal with jurisdictional matters.
“However, the Council clarified very well more than a month ago that the thematic axis would be exclusively on the Constitution of the Republic of Paraguay,” stated Dr. Paciello, also adding that, despite the incredulity of the people, They are focused on improving and part of that process involves becoming more demanding in the procedures of the institution.
The note of the request for the new examination indicated that the Council of the Magistracy violated its own regulations, Article 12.1, by including leading questions that did not really ask the nature of the functions for which the examinees participated.
The head of the Council pointed out that knowledge of the Constitution represents something basic, elementary and even a condition to enter the field of jurisdictional activity.
However, those who could not pass the test also questioned that in the evaluation no question was asked about aspects of constitutional dogmatics, which are related to the judicial system and process, which are essential to know the criteria and cognitive aspects of the applicants.
THE EXAM
The Council highlighted a pedagogical, inclusive and objective evaluation system that allows knowing the constitutional criteria of the applicant and, above all, the internalization of the rights, assets and guarantees of the National Constitution of Paraguay.
Among the lawyers examined were graduates and graduates in higher education, as well as educational psychologists; They indicated the lack of adherence to educational principles regarding the evaluation system developed by the Council.
According to the Council of the Magistracy, the Minister of the Supreme Court of Justice, Manuel de Jesús Ramírez Candia, as a teacher of the Judicial School, was one of those who prepared the examination on the National Constitution.
