Unanimously, the Martial Court rejected the amparo appeal filed by the defense of the former Commander-in-Chief of the Army, Juan Emilio Cheyre, and confirmed the prosecution issued by the visiting minister, Romy Rutherford. In this way, the general (R) must remain in preventive detention.
According to the resolution, the interpretation of the rules made by the judge at the time of making the decision to prosecute Cheyre is adequate, so the court -in this instance- ruled out the errors warned by the defense of the former commander in chief.

According to the agency, the claims of the defense incur in “matters that escape the amparo appeal, since they require a pronouncement on substantive issues and whose analysis is incompatible with this constitutional path.”
Likewise, the court reported that they also rejected the amparo appeals filed by former commanders Juan Miguel Fuente-Alba and Óscar Izurieta. After the ruling, the former Army chiefs may appeal to the Criminal Chamber of the Supreme Court.
