Martial Court grants bail to General (R) Juan Emilio Cheyre, prosecuted for embezzlement of public funds

The Martial Court revoked the preventive detention of the former commander in chief of the Army, Juan Emilio Cheyre, which had been ordered by the visiting minister, Romy Rutherford, after the prosecution against him for embezzlement of public funds.

In this way, he was granted bail two days after the same court rejected the amparo appeal filed by Cheyre’s defense.

“In the opinion of this Court, there are no qualified reasons to maintain the preventive detention of the accused referred to in article 19 No. 7 literal e) of the Political Constitution of the Republic, to deny his freedom and in accordance with the provisions of article 361 of the Criminal Procedure Code,” they determined.

“The appealed resolution is revoked, and instead, it is declared that provisional release is granted to the accused, under bail that will be regulated by the judge of the case, in light of the provisions of the aforementioned legal norm,” the court added. .

After the determination, it will be Minister Romy Rutherford who will have to set the amount to be paid by Cheyre so that he regains his freedom.

It should be noted that the former commander in chief of the military institution has been held in the Peñalolén Military Police Battalion since October 25, resorting to this court instance after Rutherford denied him the benefit.
