The round of testimonial statements in the case that investigates illegal espionage from the AFI in the macrismo will continue this coming Monday with the summons to the judge of Avellaneda, Luis Carzogliowho could ask to postpone the process as Mariano Macri, the brother of former President Mauricio Macri, already did.
On the other hand, in the federal court of Marcelo Martínez De Giorgi they prepare questionnaires of questions to send to two other of the witnesses who were summoned, the deputy Diego Santilli and the comptroller of the AFI Cristina Caamanowho due to their charges made use of their right to testify in writing, informed judicial sources.
As to Mariano Macrithe magistrate will reschedule the hearing after the former President’s brother asked to postpone it for health reasons.
Carzoglio is scheduled for Monday for the procedure that would be done through the Zoom platform, but according to sources in the case, he could request a postponement.
The Avellaneda judge was suspended and is currently on leave and was summoned so that “it is issued about possible meetings that he could have had with Allan Ruiz and Juan Sebastian DeStefano“, two former AFI officials charged in the case.
Carzoglio denounced having received pressure to sign an arrest warrant against trade unionist Pablo Moyano, something he did not do, when he was in charge of the Avellaneda court.
Martínez De Giorgi ordered the subpoenas to testify under oath of truth, among other 43 measures of evidence that he ordered after being in charge of the investigation that passed from the federal jurisdiction of Lomas de Zamora to Comodoro Py by order of the Federal Court of Cassation.
In the case, the former heads of the AFI in the macrismo were prosecuted, Gustavo Arribas and Silvia Majdalanitogether with ex-hierarchical members of the organization and ex-agents.
But when the case reached Comodoro Py at the request of the defense attorneys of the accused former officials, the Federal Chamber of Buenos Aires reviewed the resolution in Lomas de Zamora and concluded that there was no illicit association in the AFI, but that it was the illegal “self-employed” action of a group of spies that was not properly controlled by the body’s second, Majdalani.
Arribas, Majdalani and the rest of the defendants received a lack of merit for this crime.
The former official was prosecuted for alleged “breach of duties” as a result of not having controlled the activity of the group of agents known as “Super Mario Bros” by the name of a WhatsApp group that they were part of and that did remain with confirmed prosecution for infraction of the Intelligence Law.
The Federal Chamber ordered to deepen the investigation to the new judge of the caseMartinez De Giorgi.
The magistrate ordered the New measures and, among them, requested “very urgent” reports from the Judicial Directorate for Complex Crimes and Organized Crime (Dajudeco) on the existence of “a delivery system for judicially intercepted calls” between that body and the AFI “to through a dedicated link or similar mechanism”.
The comptroller of the AFI Caamaño informed the judge about the existence of 105,000 audio files found in the agency with wiretaps made by court orderwhich would have been derived directly from the Dajudeco to the AFI and which were not destroyed.
Martínez De Giorgi required that Dajudeco report “if during the years 2017 to 2019 this system was operational; if the referral through that system was carried out on all the lines intercepted and whose withdrawal was judicially authorized by the AFI, or if an express request from said Agency was required in each specific case to proceed with said referral”, among other points.
The AFI was required, among other measures, to report the “numbers of telephone subscribers whose ownership and/or use and/or allocation had been affected, according to its records” between January 1, 2017 and December 31, 2017, prior to declassification. December 2019 to Arribas, Majdalani and 24 others under investigation.
