The president of the Superior Electoral Court (TSE), Minister Alexandre de Moraes, said today (3) that the president-elect Luiz Inácio Lula da Silva and the vice president, Geraldo Alckmin, will be graduated until December 19.
“The elections are over. The second round ended democratically last Sunday [30]and the TSE has proclaimed the winners, who will be graduated by December 19th and will take office on January 1st, 2023”, said Moraes near the end of the plenary session that the Court held this Thursday.
Highlighting voter participation and the speed with which the TSE announced the result of the election, Moraes declared that “democracy won again in Brazil”. The minister warned that anyone who uses illegal strategies to question the will of the majority of voters will be identified and punished.
“This is democracy, it is alternation of power, it is a republican state. There is no way to contest a democratically publicized result with illicit, undemocratic, criminal movements. These will be fought and those responsible will be investigated and held accountable under the penalty of law,” said Moraes, recalling that international observers and technicians from the Federal Audit Court who audited around 4,161 ballot boxes attested to the legality of the Brazilian electoral process and the security of electronic voting machines.
“Once again, the electoral observation missions released their notes and, again, reiterated the total reliability of the Brazilian electoral system and electronic voting machines. The OAS mission [Organização dos Estados Americanos] stressed that, “once again, the TSE demonstrated its high level of professionalism and solidity, which allowed it to successfully carry out an electoral process in a complex context, marked by polarization, disinformation and attacks on electoral institutions”, concluded the minister.
Diplomacy
During the graduation ceremony, the TSE certifies that the candidates for the Presidency of the Republic and for the Vice-Presidency were effectively elected and are able to take office. The delivery of diplomas is only carried out after the end of the period for legal questioning of the result and final processing of the result of the elections.
In the case of governors, senators, federal, state or district deputies and alternates, the diploma is made by the regional electoral courts of the 26 states and the Federal District, which must also observe the deadline of December 19.
Male candidates who do not present the document of discharge with mandatory military service cannot be graduated, nor those elected whose candidacy registration has been rejected, even if they are still awaiting the final decision.
