Santo Domingo.-President Luis Abinader is preparing to convene the National Council of the Judiciary (CNM) with its new composition that now includes the president of the Constitutional Court to replace the Attorney General of the Republic, who will now be appointed by that body.
The president explained that, with the recent proclamation of the new Constitution, it is necessary to exhaust this procedure to guarantee continuity and efficiency in the highest judicial instances. «Let’s see what the process is; Therefore, I imagine that it should be done in the coming weeks to carry out the necessary consultations,” he said.
The proclaimed Constitution also establishes among its modifications to vary the composition of the National Council of the Judiciary and also includes the power to appoint the Attorney General of the Republic proposed by the President of the Republic.
The current attorney Miriam Germán Brito has remained in office until her replacement is appointed under the current scheme. She has expressed her intention not to continue in office, so President Abinader is expected to propose a candidate.
New judges
In the next call, four judges of the Supreme Court of Justice (SCJ) must also be appointed to fill the same number of vacancies whose incumbents have completed their term.
The judges whose term expired are Moisés Alfredo Ferrer Landrón, Blas Rafael Fernández Gómez, Pilar Jiménez Ortiz and Manuel Alexis Read Ortiz, who were appointed in 2017.
The CNM must also choose the members of the Superior Electoral Tribunal when their term expires. The Constitution of the Republic establishes that the period for which the judges of the Supreme Court of Justice are elected is seven years and at the end of the same period the National Council of the Judiciary will evaluate them and decide whether to ratify them in office or the replaces.
The term of the judges of the Superior Electoral Court is four years.
The constitutional body for choosing the judges of the high courts is made up of the president of the Republic, the president of the Senate and a senator belonging to the second majority of a party or coalition different from that of the president of the Senate; the president of the Chamber of Deputies and a deputy from the second majority of a party or coalition different from that of the president of the Chamber of Deputies; the president of the Supreme Court of Justice and others.
