The minister of the Supreme Court of Justice of the Nation (SCJN), Loretta Ortiz Ahlf, obtained a new impediment that will allow her not to intervene in the constitutional controversy promoted by the Attorney General’s Office, which opposes revealing the folder investigation against Pío López Obrador for alleged electoral crimes.
Last February, the minister was authorized not to participate in the discussion of this matter, and now she has also been excused from voting on a claim on the same issue. This is because Ortiz Ahlf is the wife of José Agustín Ortiz Pinchetti, head of the Specialized Prosecutor for Electoral Crimes, directly responsible for the investigation that is claimed to be published.
The personal link that unites the minister with a person who works in the Office of the Attorney General of the Republic, who was involved in the procedure from which the contested act derives and who, in addition, was designated as a delegate to act in the constitutional controversy of origin, could generate an apparent conflict of interest, since what is sought is the impartiality of the minister and of this Supreme Court of Justice of the Nation
said the rapporteur minister, Juan Luis González Alcántara Carrancá, when presenting the project that was approved unanimously in the plenary session of the SCJN.
He added that If it has already been determined that the minister cannot hear the main constitutional controversy, then the natural and logical consequence is that she is not in a position to decide on the matters that derive from it, that is, from any other means of challenge. , as is the case of the appeal

Both impediments were raised by Minister Ortiz herself, in order to avoid any possible conflict of interest.
