Lima Routes He also noted that the temporary suspension was adopted preventively, “to protect the safety of its workers and users.” In its statement, the company accused the Municipality of Lima and some political representatives of fomenting “social unrest” in the collection areas, by promoting protests against the concession.
The concessionaire warned that it reserves the right to take legal action against acts that it considers arbitrary on the part of the State. Along the same lines, he urged the authorities to respect current contracts and the legal framework that regulates the operation of tolls in the capital.
Judicial Power ordered to suspend toll collection of Rutas de Lima
On October 29, the Judiciary ordered the company Rutas de Lima SAC to immediately suspend the collection of tolls at the Villa and Punta Negra stations, located on the Panamericana Sur, while the ongoing judicial process is resolved. The resolution included financial sanctions in case of non-compliance.
The decision was based on a precedent from the Constitutional Court that determined that the absence of adequate alternative routes for users violates the right to free movement. The new measure also questioned whether the charge would be maintained despite this problem.
The Municipality of Santa María del Mar—manager of the lawsuit—applauded the ruling and pointed out that this decision represents progress in the defense of citizens. For its part, Rutas de Lima described the resolution as arbitrary and warned that it is studying legal actions against the State.
Rutas de Lima faces a long dispute with the Municipality of Lima
The controversy between Lima Routes and the Metropolitan Municipality of Lima (MML) has been dragging on for several years, mainly due to the questioning of the conditions of the concession contract signed during previous administrations. The municipality has promoted several legal actions to suspend the collection of tolls in different parts of the city. Panamericana Sur and the Panamericana Norte.
The recent ruling of the Judiciary that ordered the collection to stop in Villa and Punta Negra was promoted by the MML Attorney’s Office. However, the concessionaire appealed the decision, which – in accordance with current legislation – stops the execution of the measure until there is a final resolution from a higher instance.
