The Second National Criminal Court of Appeals declared inadmissible the challenge presented by the technical defense of the mayor of Anguía (Cajamarca), Jose Medina Guerreroagainst the head of the Eighth Preparatory Investigation Court, Raúl Justiniano, and ordered that he continue carrying out the process in accordance with the law.
In its resolution, it considered that the arguments referring to the fact that the judge had not complied with the procedural deadlines for the investigation is a “factual support” that it is not received and does not correspond to the status of this process, which is in the preparatory investigation stage.
It also maintains that the delay of a few days in giving action to the requests made by the procedural subjects, does not constitute a reason to affirm a violation of the constitutional principle of the impartial judge or biased conduct as exposed by the appellant.
Thus, it states that this circumstance can be corrected by other control mechanisms, such as the request for an interview with the magistrates themselves who are in charge of their processes and do not establish a cause that justifies their removal from the case.
It should be noted that the session on September 5, where the impediment to leaving the country against the first lady Lilia Paredeswas suspended due to the challenge filed against Judge Raúl Justiniano.
As recalled, José Nenil Medina is serving 30 months in preventive detention in the Ancón prison, while Yenifer Paredespresident’s sister-in-law peter castleis serving the same prison term in the Women’s Annex Prison of Chorrillos.
Both characters are investigated for the alleged crimes of criminal organization and money laundering. They also ordered the search of their homes and the seizure of documents, jewelry, money, vehicles, cell phones, computer equipment or any object linked to the crime.
