He Constitutional Court decided to suspend investigations against Dina Boluarte while his government lasts, which still ends ten months later. The former president of the TC, Marianella Ledesmawarned that the measure shields to the president because it prevents an adequate gathering of evidence. “This is a mockery to the efficiency of criminal investigation because time erases the footprints,” he warned in dialogue with the Republic.
“(The ruling) is pro crime, pro impunity of corruption. If justice does not intervene in a timely manner; later, whatever is done will be merely declarative because the evidence will no longer be possible to take,” he explained. He stressed that Boluarte “will have power in the crime scene”, because it has a considerable time to intervene in evidence.

In order for an investigation to be efficient, it is necessary that the tests be collected in a timely manner, something that prevents the last fault of the TC. “If I know a criminal story, I have to go to the scene, take the evidence, footprints, data, cameras, statements. All these tests I keep them, I keep them, and then continue with the following phases of the process when his mandate culminates,” he details about the process that must be followed.
What the Constitutional Court has raised is that only statements of the president could be taken and, after her mandate, tests could only be collected so that the investigation continues. If the necessary probative material is not able to collect, the crime is unpunished.

Differentiated treatment
On the other hand, an observation of Ledesma is that the decision of the TC also reflects a selective treatment towards president that was not considered in the case of former president Pedro Castillo. “With Castillo, welcome the investigation; with Boluarte, there is no research,” he said.
