The First Sentencing Court, which will judge former president Jeanine Áñez, was recently formed. the three judges that compose it were inaugurated in January of this year, dof which they agreed to the position through a call, as reported by the lawyer Jorge Valda, one of Áñez’s defenders, in time to denounce that a modification of the notes of that call was made so that the lawyers can access the position.
“Marco Antonio Vargas Yupanqui and Liz Avilés Condori are the judges who will judge the former president, they irregularly accepted the positionthere are documents that prove how they came to office”, denounced Valda.
He explained that Vargas Yupanqui and Avilés Condori are part of the First Sentencing Court along with Germán Ramos, who is the president of that courtroom. The first two attended a call by the Council of the Judiciary in October 2021 together with hundreds of lawyers to opt for two of the acephalies that this Court had.
According to the documents presented by the plaintiff’s attorney, candidates for judges had to pass three types of tests, As a whole, the evaluation was for 100 points distributed in three areas, a merit test of 40 points, another of competence also of 40 points and a personal interview that was worth 20 points.
In the case of the lawyer Marco Antonio Vargas, achieved 34 points in merits; in the competition exam it appears with a note of 20 points; while in the interview he scored 13.67 points, which means a total of 67.67 points in total.
According to the ‘Manual of the subsystem for admission to the judicial career – mode of competition of merits and competence exams’, presented by the complainant Jorge Valda, there are minimum grades that applicants must obtain; in the case of the merits and the competency examination, the minimum grade is 21 pointsthose who do not obtain that minimum will be disqualified, points out numeral II of article 15 of that manual.
Vargas Yupanqui had to be disqualified because he only got 20 points in the competition; but nevertheless, in the final rating table the aforementioned appears with 22.4 points and a global of 70.07 points, which places him in second place among those qualified.
In the case of attorney Liz Avilés Condori, she achieved 23.2 points in the competency exam; 26 points in merit and 15 in the interview, which gave him a total of 64.2 points. The problem in this case is that turned out to be fifth in points, the first was the lawyer Ángel Arias Morales, who achieved a total of 84.33 points, but was not elected.
According to the complainant, these are the irregularities of the two appointments.
On Thursday, this Court decided to postpone the start of the trial against Jeanine Áñez and nine other people, former police and military chiefs, for the ‘Coup II’ case. The defense attorneys of the accused denounced procedural irregularities in the process and now the complaint about the appointments arises.
