Lawyer sees unprecedented referral to trial on the merits of the accused Antipulpo case

The lawyer for the Dominican State today considered the decision that sent 21 natural persons in the Antipulpo case and its companies to trial on the merits as an unprecedented act.

The litigant Jorge López Hilario, who represents the State in the administrative corruption process, argued that for the first time an Investigating Judge accepts a State motion in all its parts.

“This is an unprecedented event in the fight against corruption and impunity. The Court of Instruction admitted the quality of the Dominican State to become a civil actor to claim the damages caused by the illegal actions, ”said the lawyer.

During the process, the defendants Francisco Pagán, former director of the State Works Supervisory Office; Julián Esteban Suriel Suazo, Lewin Ariel Castillo and Domingo Antonio Santiago made agreements with the Public Ministry, which were accepted as good and valid by the court.

All the defendants in this case were sent to trial, only with the exception of those who had agreed with the Public ministry.

Product of the agreement, the State will recover more than 200 million pesos in goods.

The judge issued an opening order against Juan Alexis Medina Sánchez and his companies, Carlos José Alarcón, Aquiles Cristofer, Antonio Florentino, Rigoberto Alcántara Batista, Fulvio Antonio Cabrera, José Idelfonso Correa, Libni Valenzuela, Francisco Brea and Víctor Encarnación Montero.

Also, against Lina Ercilia Vargas, Pacristy Ramírez, Carlos Martín Montes de Oca and Paola Molina and her company, as well as Fernando Rosa and the company RyT, José Dolores Santana, Wacal Vernabel Méndez, Carmen Magali Medina Sánchez, Rafael Antonino Germosén Andújar, José Miguel Genao – Editorama and Lorenzo -Freddy- Hidalgo.

Regarding the plaintiffs, the judge rejected the appeal presented by the defenses of the non-participation of the State’s lawyers in the judicial process.

Regarding the unconstitutionality, also presented by the defense of Juan Alexis Medina Sánchez, Peguero said that no violation of the Constitution was observed.
