As reported at the time, the suspension measure was approved by the full Council, after Arturo Fernández was sentenced for having defamed PNP Lieutenant Nataly Rojas.
He’s going to avoid it
According to the lawyer, what Arturo Fernández is trying to do is to avoid at all costs being sentenced a second time for the same crime before he can resume his duties as mayor.
“His objective would be to face the oral trial for aggravated defamation (the case of the archaeologist Ricardo Morales) once he has returned to his position as mayor. He is waiting until January 9 to collect his mayoral credentials; then he will appear in court, and he can remain there for 24 or 48 hours at most, and then he will return to his activities. He will face the judicial process as an authority and that is another thing,” commented Greco Quiroz.

And the vacancy?
Why are you so sure that the National Elections Jury (JNE) will not remove you from office before then?, we asked.
“I have serious doubts that this will happen, because the reason is having a final and res judicata conviction, but that final conviction has already disappeared due to the effects of a rehabilitation issued by a court. I want to see what criteria the JNE will have; but if you ask my opinion, I believe that it will declare the vacancy unfounded,” he replied.
However, MPT councilor Jorge Vásquez Tirado is confident that the electoral body will soon make a decision and permanently remove the questioned former mayor from office. “Before the date of his suspension is met, the JNE will vacate him,” said the councilor.

Delay
Speaking to N60, lawyer Fernando Calderón, who filed the petition for vacancy against Arturo Fernández, said that there are council members who would be delaying the process. “We have not been notified of the Council agreement in which they denied us reconsideration to be able to appeal to the JNE. The signature of two council members is missing from the minutes,” Calderón revealed.
