The defense of the instructor of the Military College who was apprehended this Tuesday morning (04.25.2023), revealed that his defendant ordered the two cadets to suspend the military exercise of the ‘leap of death’ from the tower and the command was not obeyed.
Ricardo Maldonado, lawyer for Lieutenant Juan José Patzi, assured that the order was transmitted by radio on three occasions, a phrase that he assures does not appear in the video that was released days ago on social networks.
He maintained that the order given by the instructor to “jump together at once” referred to the four uniformed men seen in the video, before the two cadets who were injured carry out the exercise and after that, the instruction is given not to jump.
“He ordered the suspension of the act on three occasions. It was an unfulfilled order and they did not comply negligently, it is an arbitrariness of the cadets,” Maldonado said.
He pointed out that the accident occurred not for safety reasons, nor because the ropes or the anchorage were bad, but because both cadets they were not prepared.
The lawyer claimed the innocence of the instructor and questioned that be prosecuted by ordinary justice when there is a military procedural code and a military penal code.
“Every military center, barracks, including camps, if any crime occurred, must be investigated, prosecuted and tried by military jurisdiction”, he remarked.
Despite this, the formal imputation is awaited by the Prosecutor’s Office against the instructor, however, the case is already being investigated for the alleged crimes of serious and minor injuries.
Evo questions the Army commander
Through his Twitter account, former President Evo Morales questioned that Army Commander Juan José Zúñiga only visited the hospitalized cadets the day before, when he had the opportunity. to suspend the festivities on the anniversary of the Military College.
“I suspect that the Army commander was just looking to talk to the two cadets who suffered the fall in the so-called leap of death, when he did not even stop the celebration on the day of the tragedy,” he said.
He called for it to be done an investigation to determine if there was racism to the injured, as the families demand justice in this case.
