The Court of Justice of São Paulo suspended Law 1,398/2024, which institutes the Military Civic School Program in the state. The law is one of the main causes of the current governor, Tarcísio de Freitas, and was approved by the Legislative Assembly. The state government estimates that three hundred units will join the program, which is still in the public consultation phase with school communities.
Approved in May, the device was the target of a Direct Action of Unconstitutionality (ADI), authored by the Union of Teachers of the Official Education of the State of São Paulo (Apeoesp) and the Union of Teachers and State Education Workers, one day after its enactment, which was initially denied.
The entity requested reconsideration, accepted on Tuesday (6) by Judge Figueiredo Gonçalves, of the Court of Justice of São Paulo, who suspended the law until the judgment of another ADI, 7662, proposed by the PSOL party in the Federal Supreme Court (STF) and distributed to Minister Gilmar Mendes.
The Supreme Court has no date set for a ruling on the case, but Figueiredo’s decision considers that it would affect schools if it were accepted after they began implementing the model.

According to the president of Apeoesp, professor Fábio Limeira, “we are living in a time of great tension at school, with an authoritarian platform that makes the work absolutely exhausting. At first, only the principals of these schools gave their opinion, and now, in many of them, there is an attempt to impose acceptance and silence the school community. This is not what we want; what we want and need are working conditions and the appreciation of professionals.”
When contacted, the State Department of Education responded that it had not been officially informed of the decision.
The State Attorney General’s Office reported that it is analyzing the case and will appeal the injunction.
