From January 2026, those who have fibromyalgia will be considered a disabled person (PCD). AA Law 15.176 of 2025, which determines the measure, was published on Thursday (24) in the Federal Official Gazette, after being sanctioned without veto by President Luiz Inacio Lula da Silva. The approval by the National Congress took place on July 2.
The standard is valid 180 days after publication.
THE fibromyalgia is a syndrome that causes muscle painin joints, dizziness, fatigue, anxiety and depression, and has no known origin. The origin is in the so-called “central sensitization”, a dysfunction in which pain-bound neurons become excessively excitable.
Among the rights that will be extended to people with fibromyalgia are quotas in public tenders and exemption from Tax on Industrialized Products (IPI) in the purchase of vehicles.
A health team, with doctors and psychologists, will have to attest to the limitation of the person to participate in activities on equality with other people.
In the Federal District, for example, those who have fibromyalgia can already be considered with disabilities. Now the law is valid for all the country. The Unified Health System (SUS) offers treatment for those with the syndrome.
