Last week, with the courage that has characterized other rectors in the past, Dr. Enrique Graue responded to a series of accusations that public opinion and the university community had made regarding plagiarism -indicated by the FES Aragón – that Minister Jazmín Esquivel committed.
Dr. Graue raised the need not to resort to summary trials and defend the autonomy of UNAM, following the procedures and times established by university legislation. What is due, is to bring together the ethics committee of the university council and that this body issue the guidelines or measures that must be taken to resolve the situation of the now minister Esquivel and validate or not her degree in law.
And, you have to resort to the university council, because there is no express legislation that punishes plagiarism, since for the university community it was impossible for the thesis guide and his student to agree to commit said offense. So in addition to amending this gap in university legislation, measures will have to be taken that can only arise from an agreement of the highest governing body of the UNAM.
With this decision, the rector not only does not directly confront the government with whom he has already had previous friction derived from the belligerence of the executive with his alma mater, but also favors an institutional solution and in accordance with the legality that the 4t bothers him so much.
Conversely, last week, almost at the same time as the rector’s address, deputy Alejandro Robles Gómez, a member of Morena, proposed reforming the Regulatory Law of article 5 of the Constitution regarding the exercise of professions in CDMX.
In his project, he proposes that, in order to provide certainty and legal certainty, “the powers of the General Directorate of Professions and of the university authorities that issued the professional title to carry out the annulment of the registration of the professional title and revocation of the of exercise with patent effects, prescribe in a period of five years counted from the obtaining of the professional license with patent effects”.
Knowing that only with the majority of their party, it is possible to modify a regulatory law, in an act that only deserves the name of desperate, the party in government is preparing to change a law that has a very specific and concrete addressee, the Minister Jasmine Esquivel herself.
The legislation itself prohibits the making of laws with a private addressee, but since retroactivity proceeds for the benefit of any person, with this they save from the legal perspective, the fate and destiny of the minister.
The blow, however, is given. In the first place, to the minister who, the more she has wanted to defend her saying, the more she has sunk into the sand. She has committed, in the opinion of not a few experts, crimes by fabricating false evidence and issuing supposedly before a notary public, declarations of people who have later proven that they never declared such things. Second to the Court, the minister’s presence is unsustainable from many perspectives. Every time she pronounces herself on any matter, there will be doubt about the validity and honorability of her statement. And finally to UNAM, because the scandalous issue has caused unnecessary pressure on our house of studies.
The question is forced: why save at all costs a minister who represents the 4t, within the Court? The government comes out scratched, the deputies of Morena give further proof of their obsequiousness and docility in front of the president and with this bill, to save her, we leave without evaluating and demanding that professionals, for example health, engineers or all those who have human lives in their hands, continue exercising without being able to do anything to them, that is, in total impunity, nothing more, but nothing less, too.
