The Buenos Aires Minister of Health, Nicolás Kreplak, participated in the presentation to the Provincial Legislature of a project that seeks to modify Law 10,471 so that the personnel of the Organization and Assistance of Operating Rooms and the graduates in Education for Health are incorporated, since which, he stated, “We seek to prioritize the nursing career”.
The initiative that promotes the incorporation of graduates in Organization and Assistance of Operating Rooms and graduates in Education for Health under the regime of Law 10,471 was presented 20 days ago in the Buenos Aires parliament.

The project called “Exception Law” will allow, in addition to this incorporation, the automatic transfer of nursing graduates, as well as other disciplines, from Law 10,430 (public employment) to Law 10,471 (hospital career), recognizing and prioritizing the task performed every day in hospitals and health centers by various professionals.
In this framework, Kreplak and the Minister of Labor, Walter Correa, were part of the “Open Council for the passage of Law 10,430 to 10,471” that took place in the annex of the Chamber of Deputies.
“This proposal seeks, on the one hand, the incorporation of some new specialties that are very important in the professional career law, graduates in health education and in the operating room”explained the minister to the press.
In addition, he maintained that “we seek to prioritize the nursing career” and explained that it is intended to promote that nurses who started working as such without having a degree “continue training until they obtain it.”
“But if they are received from graduates they have to have recognition. So, we want those who entered as a nurse and then acquired a professional rank through training, to be able to be ranked in Law 10,471 without going through a competition again or getting a vacancy or new plant,” said the minister.
Then, Kreplak analyzed that just as graduates in Surgical Instrumentation, Obstetrics, Kinesiology or Psychology are recognized as health professionals, “there are no reasons not to recognize a graduate in Nursing, a fundamental sector of the health system and hospitals “.

“Eva Perón did so much to build and prioritize the nursing school, with a strategic vision. So many years later, not recognizing her work is discrimination without reason. This is an administrative exception: we seek to prevent them from having to go to a new contest or seek a new plant when they are already carrying out this task when they graduate”, he concluded.
If the rule is sanctioned, the pass to Law 10,471 will be automatic, permanent, exceptional and only once.
It will also include university and/or tertiary professionals who meet the following characteristics: stability in the regime of Law 10,430; development of any of the activities included in article 3; university and/or tertiary qualification for the activity they carry out; and that they have all the admissibility requirements established in Law 10,471.
This exceptional incorporation was raised by virtue of the fact that in the province of Buenos Aires, there are professionals who carry out tasks in assistance establishments dependent on the Ministry of Health under two different statutory regimes: Laws No. 10,430 (Personnel of the Public Administration of the Province of Buenos Aires) and No. 10,471 (Personnel Included in the Hospital Professional Career).
This situation generates inequality between professional peers, mainly because those who are under the administrative appointment cannot present themselves in competitions for functions, within the framework of the normative plexus of the Hospital Professional Career.
To carry out the incorporation, the position of the holder of the interested parties will be converted.
In turn, the aforementioned automatic incorporation will not become effective if the agent expressly expresses his or her wish to remain in the statutory regime in which he or she finds himself or herself.
For the vice president of the Trade Union Association of Health Professionals of the province of Buenos Aires (Cicop), Silvana Scali, through this proposal “about 5,000 people will be able to move on to the hospital career” because “the bulk continue to be graduates in nursing but who often enter the system as auxiliaries and must be recognized”.
The union leader explained to Radio Provincia that “the idea is to promote the treatment of this Law that is so necessary” because it is about “a historic recognition for those who have been supporting health services day by day and especially in the pandemic.”
In addition, he stressed that “in addition to passing the law automatically, we are going to expand the professions specified in article 3 of the hospital career: We are going to add degrees in Bioimaging, Surgical Instrumentation, Physical Education, Labor Relations and several more than at this moment are personnel who are working in hospitals and will be able to access better working conditions and a better salary”.
