This weekend, the Presidency issued Resolution 227 of 2022, which regulates the Decree 811 of 2021which regulates and establishes the guidelines for the industrial use of cannabis in the country.

With this regulation, the protocols and mechanisms for the export of dried cannabis flower were defined, as well as the scope of its industrial uses.
WHAT IS THE OBJECTIVE OF THE RESOLUTION?
In this case, the decree seeks to establish the requirements for licenses and quotas, as well as the use of the components of the cannabis plant in foods, beverages and dietary supplements. In turn, the conditions under which the plant may be used for scientific, medicinal or industrial purposes are established.
HOW TO REQUEST THE LICENSE AND QUOTE?
This process will be carried out through the Information Mechanism for the Control of Cannabis (MICC). According to the mode of use, the licenses will be processed in the respective entity.
In this range of possibilities is the Invima and the Ministry of Justice and Law. These new licenses do not leave aside the control of each case.
HOW TO REQUEST THE LICENSE EXTENSION?
In the case of those who have a license for a period of 5 years, under Decree 613 of 2017, and want to extend this permit, they must submit the corresponding payment. In turn, it does diligence 3 months before the license expires.
HOW MANY QUOTATIONS CAN YOU APPLY?
The number of licenses will depend on the scope of the activity that you seek to develop with the cannabis plant and the modality.
The small or medium growers are all those individuals with annual gross income of up to 3,500 Tax Value Units (3,500 UVT). You must also have assets no greater than 11,250 UVT.

WHAT PLANT COMPONENTS CAN BE USED?
For the preparation of food, beverages, alcoholic beverages and dietary supplements, you can use the vegetable component, grain and non-psychoactive derivatives of cannabis.
In the case of export, these products can be made with CBD, complying with the requirements of the country of destination. The commercialization of this type of product, in the national territory, will depend on the regulations of the Ministry of Health.
WHAT SHOULD YOU DO TO EXPORT CANNABIS?
– Having requested the inclusion of the export modality in the psychoactive cannabis cultivation license.
– In the case of psychoactive cannabis, have requested the respective quota.
– In the case of non-psychoactive cannabis, a quota will not be required and you will only have to indicate the number of filing in the Foreign Trade Single Window

This procedure only applies for scientific purposeswhile the resolution on foreign trade is issued, which will stipulate the conditions for the case of commercial use.
