The Court suspended the administrative process of the city of São Paulo for the construction of housing units in the region of Cracolândia, in blocks 37 and 38 of the Campos Elíseos district, in the center of the city of São Paulo. At the site, the municipal administration intends, through a public-private partnership (PPP), to demolish existing buildings to erect housing units.
The Public Ministry of São Paulo (MP), author of the action, says that the city’s initiatives, which are part of the Redemption Program, cause damage to the city’s historical and cultural heritage. According to the MP, the revitalization project, in its current form, does not respect the guidelines of the Council for the Defense of Historic Heritage (Condephaat).
“Given the imminent risk of demolition or devaluation of listed properties, I partially grant the preliminary injunction to suspend the administrative approval process for the project in question”, said judge Antonio Augusto Galvão in his decision, published yesterday (17th). of France, of the 4th Public Finance Court of São Paulo.
However, the judge did not grant, in an injunction, the MP’s request for the city hall to present an alternative project for the area. “At this point, I don’t see enough urgency for the granting of the measure without the previous hearing from the opposing party”, highlighted França.
In a statement, the city of São Paulo informed that it will appear in court and appeal the decision, “demonstrating the regularity of the municipal action”.
According to the city hall, the objective of the Redemption Program is to promote health care, social reintegration and professional training for people who abuse alcohol and other drugs and are in a vulnerable situation. PPP Housing intends to offer, in the Cracolândia region, social interest housing (HIS) and low-income market housing (HMP), associated with the implementation of infrastructure and social equipment.
