The Regional Electoral Court (TRE) of São Paulo decided today (7) cancel the transfer of former judge Sergio Moro’s electoral domicile from Curitiba to the city of São Paulo. With the decision, Moro, who is affiliated with União Brasil, may be barred from running for any office by the state.
The plenary’s decision was motivated by an action filed by the Workers’ Party (PT). According to the legend, Moro indicated that he resided in a hotel and did not prove a residential, family or professional link with the state, requirements required by electoral legislation for establishing the electoral domicile.
By 4 votes to 2, the majority of the court followed the opinion given by Judge Maurício Fiorito. According to the magistrate, Moro was unable to prove the minimum three-month bond with the city to justify the transfer of the electoral domicile.
“It is not asserted that the defendant acted or not in bad faith in order to deceive the Electoral Justice, but only that there was no evidence in the records that, in fact, he had any link with the city of São Paulo when he requested transfer of his domicile,” he said.
Appeals can be made to the Superior Electoral Court (TSE), which will give a final decision on the matter.
