The Court of Justice of São Paulo determined that the ITA (Itapemirim Transportes Aéreos) re-accommodates three passengers (a couple and a baby in arms) on another airline.
According to a decision by Judge Morais Pucci, the relocation must be completed urgently. The magistrate also determined a daily fine of R$ 500, limited to the total value of the tickets, in case of non-compliance by the ITA.
According to the family’s lawyer, Felipe Alves, the trip from São Paulo to Recife had been planned by the family since the middle of the year, during which time tickets were purchased and accommodations were booked for one way on December 29, 2021 and back on December 29, 2021. January 5, 2022.
financial losses
For Felipe, the reimbursement of tickets, which has been usual in the case, is not in the family’s interest. “They do not want reimbursement, but re-accommodation, because they may have financial losses in relation to what has already been spent on tickets and accommodation”, he explained.
The family is among the more than 45,000 people affected by December 31, 2021 with the suspension of company operations, which occurred on the airline’s own initiative on December 17, without notice to users.
