In an hearing held on August 29, the agro -environment court determined three precautionary measures ex officio. Among the decisions assumed, the “Immediate attention of forest fires”In Bolivia. The measure is taken at a time when the country faces a new stage of burning.
The new decision establishes that the central level of the State, through the Ministry of Environment and Water, must attend with “urgency character” the suffocation of forest fires in fiscal lands not available and in the protected areas administered by the SERNAP, coordinating the necessary actions in the face of the imminent danger in different regions of the country.
Jhovi Morales, responsible for the legal issues of the Earth Foundation, said that this measure is due to the fact that the fires and the affected surface are increasing, so it is sought to put a brake on the permits granted by ABT.
“These authorizations are sought to paralyze and a firmer presence of the Ministry of Environment and Water is also requested. 4.4 million hectares are at risk, so this ex officio measure is activated,” Morales told El Dute.
The “Transparency in the use of resources”, Which means that the Ministry of Economy and Public Finance must inform about the allocation of resources before the admission and within the framework of the Supreme Decree that declared the national emergency, as well as the international cooperation received, according to a press release from the Agro -Environmental Court.
“In addition, the Ministry of Environment and Water was ordered, the ABT, the BIDESI, to the SERNAP and the corresponding departmental and municipal autonomous governments, send its annual operational plans (POA), approved institutional budgets and its budget execution linked to the prevention of risks by forest fires,” says the official report.
As a third precautionary measure, the court ordered the “Environmental Crimes Research”In application of the principle of prevention and defense of Mother Earth.
He urged the State Attorney General’s Office to instruct specialized prosecutors for the beginning of ex officio investigations for public action crimes linked to forest fires, guaranteeing the speed and priority in these processes.
Likewise, the Public Ministry must refer to the agro -environmental jurisdiction the background of the cases in process, within the framework of inter -institutional cooperation.
These decisions were assumed in a “audience of preventive and precautionary precautionary measures on forest fires”, which was made after a demand filed by María de los Ángeles Mamani Rocha and other activists with the aim of preventing environmental damage and protecting the rights of Mother Earth and the Bolivian population.
Background
This demand for “direct environmental action of precautionary measures” was admitted by the Court on June 5, when initial precautionary measures were arranged, but then on July 30, they were left without effect due to lack of reports that until then had not submitted different government levels.
But that procedural obstacle was overcome and the hearing of preventive precautionary measures was finally held on August 29 with the three determinations cited. Then the hearing was declared in four intermediate and will continue on September 8.
