THE Justice of Rio de Janeiro upheld in custody hearing, held on Wednesday (23), the pre-trial detention of rapper Mauro Davi Nepomuceno dos Santos, known as Oruam.
“If the arrest warrant is valid and the decision that led to his issuance was not amended, the Custody Center is prohibited from evaluating the defensive request of freedom or replacement of the arrest by another measure, under penalty of usurpation of jurisdiction. The defensive claim must be addressed to the natural court or the competent appellate body,” said judge Rachel Assad da Cunha.
Oruam was indicted for seven crimes: association with drug trafficking, drug trafficking, resistance, contempt, damage, threat and bodily injury. The pre -trial detention had been granted by the court, with a favorable demonstration of the prosecutor.
The crimes would have been committed on Monday night (21), at the door of the house of Oruam, in Joá, the noble neighborhood of the West Zone of Rio de Janeiro. The rapper and a group of friends prevented agents from the Civil Police Narcotics Police Station (DRE) from serving a seizure warrant against a teenager pointed out as one of the largest car thieves in the state and personal security of trafficker Edgar Alves de Andrade, the Doca, head of the Comando Vermelho (CV) gang (CV) in the Slums of Penha, Rio, Rio.
Oruam is the son of Márcio dos Santos Nepomuceno, Marcinho VP, one of the historic leaders of the CV, who is arrested.
The rapper surrendered to the Civil Police on Tuesday afternoon (22) in the police.
Hostility and stones
According to police, Oruam and eight other people harassed the police with curses and threw stones in the uncharacterized car. On social networks, the rapper published videos with curses and stones being thrown.
Police say one of the men who participated in the confusion ran into Oruam’s house, “which forced the team to enter to capture it.” He was filed in the act for contempt, qualified resistance, bodily injury, threat, damage and association for trafficking.
Oruam and friends fled the scene, police said. On social networks, the rapper wrote that the agents were trying to arrest him as well and raised doubts about the legality of the action. He also indicated that he went to the Penha Complex and challenged authorities. “I want to see you come here, catch me inside the complex,” he said.
Preventive arrest is decreed when a person is not yet considered guilty and has no time, and should be reevaluated every 90 days by the court.
