Judge Juan Carlos Checkley considered that there was a risk of flight for the former president of Peru, Pedro Castillo, and ordered his preventive detention. In addition, he believes that the crime of rebellion was committed for wanting to annul the cases against him, decree a curfew without authorization from the Armed Forces, and dissolve Congress. Meanwhile, it was learned that the ministerial cabinet spoke via WhatsApp just before Castillo’s action to agree on the massive resignation of what he intended to do
The Supreme Court of Preliminary Investigation of Peru, in charge of Judge Juan Carlos Checkley, ordered seven days of preventive arrest against former President Pedro Castillo, who is being investigated for the alleged commission of the crime of rebellion (alternatively conspiracy).
According to the sentence, issued on December 8, the term of judicial detention against Castillo is valid from the 7th to the 13th of the aforementioned month, after Judge Checkley concluded that there is a risk of flight and obstruction of the former president, who had planned to seek asylum at the Mexican embassy and subsequent confirmation by the Mexican president himself, Andrés Manuel López Obrador, to offer it and enforce it if approved.
“By dissolving the Congress of the Republic and establishing an exceptional government, it would have flagrantly violated article 134 of the Constitution, illegally seeking to change the rule of law model established in the Magna Carta of 1993,” they indicated.
In the same way, the judge considered that Castillo sought to annul all the investigations that were being carried out against him by having a reorganization of the Justice system, just as he said that there was planning for the rebellion because he was then the president of Peru. and dictate a curfew, something that is the power of the Armed Forces.
