In the request, the defense alleged that “the examination of the pre -trial detention decree, added to the considerations related to the cloudiness of the police action that resulted in the prison of the patient, clearly indicates that the procedural custody is illegal and unnecessary.” The defense also requested the replacement of pre -trial detention with “alternative measures”.

In the decision, the magistrate understood that the granting of an injunction is an exceptional measure, “intrinsically linked to manifest illegal embarrassment, inocurrent in the present case”.

She cited excerpts from the decision that decreed the pre -trial detention.

“Mauro’s audicious posture, aka” Oruam “, including contempt and threats to police officers, was not only through social networks, but also personally, depending on social media on social networks, referring to the day of the facts, being extremely serious and denotes that on future occasions will act in the same way, requiring arrest for the guarantee of public order.”

The judge set a period of 10 days for positions of the parties involved, such as the Public Prosecution Service and Judge Tula Corrêa de Mello, of the 3rd Criminal Court of the Capital, which determined the arrest.

Oruam was indicted for seven crimes: association with drug trafficking, drug trafficking, resistance, contempt, damage, threat and body injury.

Understand the case

On July 21, police officers went to the house of Oruam, Joá, a noble neighborhood of the West Zone of Rio de Janeiro.

The rapper and a group of friends prevented agents from the Civil Police Narcotics Police Station (DRE) from serving a seizure warrant against a teenager pointed out as one of the largest car thieves in the state and personal security of trafficker Edgar Alves de Andrade, the Doca, head of the Comando Vermelho (CV) gang (CV) in the Slums of Penha, Rio, Rio.

According to police, Oruam and eight other people harassed the police with curses and threw stones in the uncharacterized car. On social networks, the rapper published videos with curses and stones being thrown.

Police say one of the men who participated in the confusion ran into Oruam’s house, “which forced the team to enter to capture it.” He was filed in the act for contempt, qualified resistance, bodily injury, threat, damage and association for trafficking.

Oruam and friends fled the scene, police said. On social networks, the rapper wrote that the agents were trying to arrest him as well and raised doubts about the legality of the action. He also indicated that he went to the Penha Complex and challenged authorities. “I want to see you come here, catch me inside the complex,” he said.

Oruam is the son of Márcio dos Santos Nepomuceno, Marcinho VP, one of the historic leaders of the CV, who is arrested.
