The dispute between the universities and the government of Javier Milei has reached a new level of tension with the recent decision of the Justice to ask the president for explanations about the audits of the General Audit Office of the Nation (SIGEN) at the University of Buenos Aires (UBA).
The federal administrative litigation judge, Diego Cormick, has given the National Government a period of five days to report the reasons why SIGEN must audit the UBA. Judge Cormick’s measure is a response to the presentation of the UBA, which seeks to determine which body should audit national universities and has requested a precautionary measure so that SIGEN does not intervene until its jurisdiction as an audit body is defined. control.
The UBA argues that SIGEN, which reports directly to the President, only has internal control functions of the Executive Branch and has no jurisdiction to audit universities, which are autonomous. According to the UBA, this task should correspond to the General Audit Office of the Nation (AGN).
The rector of the UBA, Ricardo Gelpi, has been clear in his position: “We are in no way opposed to audits. Quite the opposite. We want to be audited as much as is necessary within the framework of the laws and institutions.
And this is why we have decided to appear before the Court so that it can decide whether the procedure that the National Government wants to carry out is within the current legal framework. We understand that it is not, but we will unrestrictedly abide by what the Judiciary decides.”
The UBA presented a “declaratory action of certainty” for Justice to define whether or not SIGEN can audit it and requested that, while it is resolved, a precautionary measure be issued to prevent it. In its lawsuit, the UBA argues that SIGEN’s intervention is unconstitutional and violates university autonomy. The university maintains that only the AGN should carry out such an inspection.
Transparency
President Javier Milei has publicly intensified his criticism of the UBA, alleging a lack of transparency in the university’s financial management. Milei has declared that “they hide behind those noble wallets of society to hide their jobs” and has assured that “the jets are not going to have peace in Argentina.”
These statements have generated a climate of tension and mistrust between the government and universities. The decision to judicialize the SIGEN audit has been supported not only by the teaching and non-teaching unions, but also by the students of the UBA.
