The federal judge in Administrative Litigation Pablo Cayssials asked the Senate for a report on the appointment of the pro-government senator Martín Doñate in the Council of the Judiciary and gave him a period of five days to comply with that requirement, judicial sources reported today.
In the official letter sent to the president of the Upper House, Cristina Fernández de Kirchner, the magistrate in charge of the Federal Contentious Administrative Court No. 9 granted a period of “5 days” for the report on the appointment of Doñate to be presented in the body responsible for appointing and removing judges.
The letter, to which Télam had access, is dated April 23 but was released this Monday.
Judge Cayssials acted from an appeal for protection that had been presented by the senators of Together for Change (JxC) Luis Juez and Humberto Schiavonifrom the intention of the first of them to assume in the Council of the Magistracy in representation of the opposition.
Once the Senate responds to the request, the judge will be able to decide.
The integration of the Council of the Judiciary became more complex with the discussion over the new representatives and a central aspect of that conflict will be whether or not the Supreme Court will swear Doñate and the radical deputy Roxana Reyes to take over as representatives of the National Congress in the body. .
Doñate was appointed to represent the second minority from the division of the Frente de Todos bench into two blocks: Citizen Unity and the National and Popular Front.
Last Wednesday, four new technical members took office in the body in front of the head of the Court, Horacio Rosatti, and, although Congress had communicated their representatives, hours before the act, Doñate and Reyes did not participate in the oath.
In the Court they explained that this happened this way because the rigorous procedure consists in that the Council sends the documents that endorse the candidate and that, once reviewed by the legal advisers, the highest court decides the date of the oath through an agreed one.
Since last Monday, when the December 2021 ruling was executed by which the Court ordered a return to the composition of the body prior to 2006, Rosatti is also president of the Judicial Council.
