Even if it were an agreed script, various relevant voices interested in keeping the National Electoral Institute safe from immediate reforms argue that the constitutional order has been broken. They say it with a media sound that makes one think of extreme situations, really authoritarian, dictatorial. Ugh: broken the constitutional order, what remains, the weapons?

Reality does not justify such dramatic outbursts. Those who proclaim almost insurmountable breaks have resorted precisely to the constitutional order, that is, they have presented objections before the Supreme Court of Justice of the Nation so that, as this highest court has historically done on countless occasions, it resolves disputes of different degrees. between powers and authorities. If there was a broken constitutional order, no one could appeal to the Court and expect it to resolve the issue raised. Atypical dictatorship would be the one denounced by those complainants if it allowed opponents to litigate against the Executive Branch and the judges agreed with them.

Such has just happened in one of the most resounding recent cases, that of Edmundo Jacobo Molina, former executive secretary of the INE, whose removal came to cause tears in a current senator who was formerly Secretary of Government with Miguel Ángel Mancera: a collegiate court in administrative matter granted a suspension of his dismissal and, immediately, reinstatement in his position.

The merits of the matter have not yet been resolved, but immediately the current constitutional order has responded, without any break, to the statements of a public servant who considers himself injured because his position has been withdrawn. And, later on, that same constitutional order will get to the bottom of the matter and decide what it deems appropriate.

The same current constitutional order will have to resolve the greater fate of this electoral issue, the so-called plan B, that the Chambers of Deputies and Senators approved by majority, but that can be overturned by the judges. Whatever they decide regarding Jacobo Molina and the plan B, the judges, with their normal functioning, demonstrate that there is no such breach of the constitutional order, no matter how much the opposition exaggerations suggest it.
