The Ethical Behavior Committee of the Judiciary has urged all judges to strictly follow the principles and values established in the Code of Ethical Behavior when drafting their judicial decisions. This is intended to guarantee public ethics, institutional legitimacy and citizen confidence in the administration of justice.
This call occurs in the context of the recent decision of Judge Rigoberto Sena Ferreras, of the Permanent Care Office of the National District, who learned of the coercive measure in the case of the National Health Insurance (SENASA).
The committee, chaired by Judge Nancy Salcedo and made up of judges Justiniano Montero and María Garabito Ramírez, fulfills a preventive and pedagogical function. Its objective is to strengthen institutional values and promote respect for judicial independence, without its role involving direct sanctions.
The magistrates indicated that judicial decisions must adhere to the principles of the Code of Ethical Behavior of the Judiciary, as well as the values of prudence and moderation in their performance.
During the meeting, Judge Sena Ferreras reiterated his commitment to ethics, transparency and respect for due process. He emphasized the importance of prudence and moderation in jurisdictional work, while highlighting the commitment of the entire judiciary to the highest ethical standards.
The Committee also urged all members of the Judiciary to reflect on their actions, both public and private, and to draft their judicial decisions with behavior in accordance with the principles established in the Code of Ethical Behavior.
In this context, it was recalled that no judge should deviate from the mandate that, when acting in his jurisdictional functions, he does so in the name of the Republic and under the authority of the law and the Constitution.
This responsibility imposes an ethical and State burden, which forces judges and judicial servants to comply with the demands of judicial ethics.
Finally, the Ethical Behavior Committee has the responsibility of guaranteeing that judges and judicial servants adhere to the ethical principles and values that govern their actions, in accordance with the Ibero-American Code of Judicial Ethics.
