The measure was ordered by Judge Richard Concepción Carhuancho. Mateo Castañeda’s legal counsel argued that due process was not respected in the witness statement.
The Judiciary refused to declare the nullity of the testimonial statement of the protected witness (Jose Encizo), as well as the three minutes of recognition, verification and corroboration made by the witness in question in the Waykis en la Sombra case.
The magistrate’s arguments include the fact that the witness had appeared before the Prosecutor’s Office spontaneously and that he feared for his life and that of his family. He also confirmed his status as a witness with the assistance of a lawyer.

According to Mateo Castañeda’s defense, the protected witness was intimidated by the prosecution to testify against him. He also indicated that the audio of the conversation was recorded after Castañeda resigned from his defense.
