Judiciary dictates 36 months of preventive detention against Jorge Barata for the Gasoducto Sur case

He Judiciary has issued 36 months of preventive detention for Jorge Barata in preparatory investigation that was initiated by the Gas pipeline case, that involves the former president Ollanta Humala and his wife, Nadine Heredia. Barata resides in the city of Sao Paulo in Brazil and must make himself available to the authorities within a period of no more than 10 business days from notification to his defense.

“Declare FOUNDED the fiscal requirement of PREVENTIVE PRISON formulated by the Provincial Prosecutor of the Second Office of the Supraprovincial Prosecutor’s Office Specialized in Crimes of Corruption of Officials – Special Team against the investigated JORGE HENRIQUE SIMOES BARATA of Brazilian nationality,” reads the resolution of the Judiciary.

The document also indicates that the authorities notify the International Police (Interpol) with the aim of collaborating in the capture of Barata so that it complies with the requirement. Jorge Barata He was incorporated into the investigation of the Gasoducto case after the annulment of his effective collaboration agreement with the Public Ministry.

This agreement, which involved the former superintendent of Odebrecht, was revoked by a decision of the Supreme Court on June 21, at the request of the Special Team, after Barata refused to testify in the trial against Ollanta Humala and Nadine Heredia.

Jorge Barata is in danger of flight

The prosecutor in charge argued that Jorge Barata has a procedural risk of flight, because he does not have assets in the country. He also determined that he would have possibilities to travel abroad because according to his immigration record it was observed that he would often travel abroad.

What is the Gasoducto Sur Peruano case?

The Gasoducto Sur case is one of the largest investigations related to the Brazilian company Odebrecht. The company allegedly gave large bribes in order to win contracts with the state for a work that was never completed.
